DPA and recruitment

This morning I got an email from Spring Technology (Best IT Recruiter of the year apparently) asking if I’d be interested in a middleweight developer position. I promptly responded with a “Do you not know who I am?” email and asked them to remove my details - with no response.
Then 2 hours later I got a call from a team leader at Spring Technology asking what the situation as twentysix was with regards to recruitment. While on the phone I asked the consultant to remove my details from the cadidate database. His response…
“That’s very hard to do, I’ll just mark you as not looking for work…”
Strikes me that they’re probably in breach of some kind of DPA directives?
Just one more reason to hate recruitment consultants…
